Well Laddies and Gents, my truck has been at Dilawri Ineos in Toronto over 2 months, and yesterday at pickup I lifted the rug before taking delivery, and lo and behold flooded with HVAC condensation. So this will now be a total of 10 months and a hand full of days in the dealership for the same initial problem. HVAC leaking in to the vehicle. There is exactly ZERO HVAC condensation leaving under the vehicle from the HVAC drains, all the liquid 100% is in the cab. My floor mats have been soaked for months, my vehicle has been wet and sloshing since day one of ownership. And the only dealership I can take it to because they started the repair has to complete the repair that they seem either incapable or unwilling to repair the vehicle. I have zero options as we have no lemon laws in Canada, and Ineos will not step in.

This vehicle is a total joke
 
I'm blown away Ineos isn't willing to help you out, at least getting it fixed.
This is the third time it’s been in to repair the same ongoing problem. Any time I reach out to Ineos the answer is simply “Drop it off” so 7 months, 2 months and 2 months and now after not even 5 minutes It’s back there again. But don’t be angry, don’t complain, don’t discourage the brand. Ineos refuses to step in. I have an email from a now “gone” general manager saying they would order me a new truck. But he’s now “gone” and you can guess where that’s going.

The dealership is completely incompetent, and Ineos doesn’t give a shit.
 
That stinks. I noticed this yesterday - first time in 26,000 miles. Will take it in on Monday.

This is terrible. I’m guessing you e already done this, but go up the chain at IA. Get a new point of contact that will chase this issue for you.
 
So you have no state/province or federal consumer protection laws that could assist in this situation? A retailer can sell something that is not fit for purpose and does not function as intended/described and that’s it? I would be just as angry at your state and federal representatives as Ineos.
 
Yeah, there’s no recourse without lawyers and lawsuits. Ineos as a small importer isn’t even part of CAMVAP a voluntary organization to arbitrate these situations.

That is so annoying as sorting the drains, Chandlers, my supplying dealer, took in their stride.
Time to lawyer up, as your dealer is not taking this seriously. I know what to do in the UK, but I have no idea how you would proceed in Canada.

How? There’s no way to contact anyone. I’ve sent emails to Lynn no response. It’s like a joke. They just want those of us with problems to disappear. The sooner the better.

Upon delivery I had an issue where my head unit had non-functional CarPlay. The dealer said IA had only experienced this with a few vehicles, and they needed to figure it out (as nothing worked). That was 1.5 years ago, but I did have regular phone calls with someone assigned to follow my case.

Your issue seems be well known and fixable, but no idea why your dealer cannot resolve it. Go direct to IA.

I have tried, I have multiple open tickets that go unanswered. This has become the bane of ownership I have had water in my truck since day one and never can they seem to repair it.
 
Isn't there a story here when IA replaced someone's vehicle down to this exact problem ? Was that in the UK?

The Uk is relatively simple as we have the ability to reject a vehicle "not of merchantable quality", and a permanent paddling pool in the footwell would qualify. That ability to reject even allows the dealer/agent/manufacturer an opportunity to fix it, but if they fail the onus is on them to put the customer right.

Canada shares some of the UK legal system, so lawyer up and follow the small claims track for the claim to fix the vehicle, (AI suggests there is one and the limits seem to be either CAN35,000 or CAN15,000, varying by province). As for Ineos Automotive ignoring you, who is actually responsible for client satisfaction? (In the UK it will be the dealer, so how is consumer rights handled in Canada?). Send the dealer and/or Ineos Automotive a 7 day letter before action by post AND e-mail, ideally with some form of proof of delivery. If they still do nothing, file the claim with the Courts. You have got to the point where you need a professional, so get one.

Commercially, they are not going to do anything until they have to, as they have already burnt the goodwill they might of enjoyed, if they had been helpful from the start. Whatever they do now is cost, so you will have to roll out the legal thumbscrews.

Go back to IA and raise the temperature (talk to someone, get to their boss, and then to their boss). Put on whatever frosting you want - early adopter, Canadian representative, professional use case, etc - then demand resolution just like every other owner that has experienced this problem. And of course hint how unfortunate it would be for their only regional Canadian dealer to be publicly shamed in automotive journals for their inability to competently work on the vehicle.
 
@IslandFalconer have you considered joining a few others in a class action? Not certain how it works in CA but there are others that I think would join you in your cause. Sure, the lawyers are the winners but you get your car fixed, replaced or something other than broken, rusty and moldy.
 
'small claims' ... i dont know how cheap you got the G for, but are you sure this is small claims only ? in the UK the small claims is meant to cover things like a leaky umbrella or a haircut accident, not huge automobile assets

I agree, but beyond small claims is a full blown lawsuit. The 10’s of thousands to spend on a law suit makes it cheaper to walk away from the vehicle in a trade. Passing on my disaster to some unsuspecting schmuck.

Although Google is a terrible way to research on legal matters, it seems that the situation is very similar to the UK, in that you can use a lawyer but you cannot assume you will be able to recover your costs, (although if the win is a slam-dunk and the otherside are considered to be acting in bad faith, the court may award costs).

In the UK I have self-represented, but I have always made sure that the matter in question is obvious and not trying to be clever. Even when I did not win, it was a pyrric victory for the other side as he had to cover his barrister's costs, (probably about £1000, all over a car worth no more than £600). If he had just settled the claim, it might have cost him £400, but his ego got in the way.

Expecting your multi-thousand dollar car to be fault free on delivery is not an unreasonable ask, so the legal issues are not complex; just sticking to the facts will probably "stick it to the man" quite effectively. Most claims are settled before the court date; for a business, getting a properly completed summons, giving the bone of contention in crisp, clear detail and the outline of how to fix the problem concentrates the corporate mind wonderfully. Explain to them clearly how to make the problem go away!
